The fines were agreed to by the Directors of Australian Mines an ASIC because the BoD's also agreed to the throwing of Benny Boy under the bus in the process as well as making admissions that the company mislead shareholders which is why the judge who proceeded over the matter stamped the paperwork, albeit his was gravely concerned about the penalty imposed not being enough and as with any Court of Law if you make Admissions then you are agreeing that what you are charged with is 110% correct and therefore you are Guilty not sure how you can construe those facts any other way...unless of course one has trouble with comprehension.
