I wouldn't second guess the judges judgement, but it doesn't seem to be a very strong claim. In fact it seems like a claim a competent Board would be able to settle instead of being a company destroying event or one that would be allowed to fester so long that any potential future capital raisings pose the risk of extreme dilution to existing shareholders shareholdings because the shareprice has fallen this low.
