Time to get over it. FAR took a gamble on bad legal advice early on. Search and you will find where it started.
The AIPN 2002 and onwards provided for pre-empts in cases of Change if Control.
when it came to my knowledge that FAR was tied in JOA predating 2002 AIPN it became clear we could be in strife. FAR wanted ICC to read more into the JOA than what was crystal clear from outset.
In any event. FAR new all along they were riding their luck and, no matter what was contained in the A4, they had more than ample time to change direction and pull out but they thought they were clever. Up till 24 Nov 2019 they were still feverishly hoping WPL will come to the table. All they got was the "bird" a mountain of pain for shareholders. Would like to see announcement of CN resignation without delay.
