Yep. Those very same lawyers are being consulted for a post-mortem of the results as they are familiar with the case.
Lawyers don't make guarantees. Everything is grey and needs a good argument and then it comes down to the arbitrators and their point of view.
Management would listen, maybe get their 50/50 chance, be pissed off with COP and decided to punt.
Punted wrong. Would have been nice to have the facts so we could make an educated punt also.
