Did Fraser know that Morilla had an arbitration agreement under UNCITRAL rules with EGFT? Does Fraser know what other arbitration agreements have been signed by Morilla SA? Is Fraser going to tell his shareholders?

Presumably the arbitration will be held in Mali, in French. Will FFX have any influence over who represents Morilla SA? How will Fraser assess the "independence" of arbitrators put forward by EGFT or Morilla SA?

I can see an Australian court potentially being asked to enforce a decision made in Mali.

If FFX has no contracts with Morilla SA why is Fraser wasting his time with this notice? I guess he can't wriggle out of the 80% shareholding in Morilla SA. Given the nature of what FFX was promoting in Australia (a $1B goldmine) it's would seem a contract of some sort did exist between FFX and Morilla SA. No doubt this is why FFX has hung onto the cash for so long.

The Africans might be smarter than our African experience BOD's. The lawyers in Mali might be smarter than the guys at G&T Perth. It's starting to look like it. If an adverse decision made in Mali is taken to a WA Court and challenged by FFX, I can see the BOD being asked the sort of thing SH's want to know. Because of this I think the BOD will roll over if their "vigorous defence" at arbitration fails. Pay up to keep the truth under wraps? I hope I'm wrong but this whole process stinks.
