I think you'll find that arbitration will not even proceed, but the company is obligated to announce the process as officially at this point the arbitration has not been retracted by the instigating party. Perhaps a retraction is imminent, let's see....
Additionally, I believe that the recent comments in detail about Boatman were to appease ASIC, who have received 10's if not 100's of complains about the 'story' and how it has been presented in the media.
