"I don't believe the onus is on FAR to prove their capability, or not, to closea deal with COP in 2016." - You also completely missed the point.

The discussion was about damages, NOT about whether FAR can prove their capability to close a deal back in 2016.

FAR in its own words stated:
"FAR is the claimant in proceedings and is seeking declaratory relief or, in the alternative, monetary damages."

    You yourself, actually said:
"If FAR wins PE rights, I believe the ICC will award a damages amount & WPL (as the beneficiary of COP's 35%) will have to decide to either leave the JV or pay compensation (damages) to FAR."

So going back to my question which remains unanswered:

Please explain to us all what damages FAR suffered from not being able to buy something it could never afford. This is important to calculate the damages that FAR would be awarded if it were successful.

For the purposes of this discussion, I am actually assuming you are correct- FAR wins PE rights, but I am asking you to explain how those damages you said you think will be awarded will be calculated.
