Incitec pivot probably feel it's worth trying to win a protracted legal battle to regain the mining lease. CXM feel they have met the criteria so don't want to donate a couple of million to make this go away.
I smell a long protracted legal battle and incitec pivot being a bully rather than a mutually beneficial partner in future dealings. Hopefully not.
