If there was greater evidence against BAL then the penalty may have been larger than $66,000. The size of the penalty suggests the evidence was not strong enough to pursue further. In fact, I think this outcome weakens the potential settlement of current class action claims, unless the courts rule that ASIC wasn't doing its job.
