As for performance shares...no, there is no "charge" to that effect. There is no "clawback" provision by ASIC at all in the SOC, care to show me where you have seen that? If there was any "illegality", then ASIC would have filed criminal charges. They havent, therefore, there is no claim that ISX "achieved the milestone shares illegally" - Its defamatory and misleading to other share holders. ASIC has filed a civil case.
