@spid81 assures holders that "The Patent application has not been rejected, IP Australia has requested more information/for EGR to be more specific in their invention to make a full assessment of the patent application. They even stated the existing approved patent where RNU has objected to the application,In simple terms, AUSPatient has asked EGR to provide more clarity to avoid another long drawn-out objection as per the first application."
WHAT THE F**K IS MANAGEMENT DOING if it is not providing a clear interpretation of this matter. This is obviously an important issue as The company sought fit to advise shareholders that:
- On 14 May 2021, the Company filed international patent to replace the provisional patent application (ref: 2020901589) relating to the EcoGraf HFfree purification process technology and the EcoGraf™ carbon anode recycling process. 23/09/2021 (via the 2021 annual report)
- the International Preliminary Examining Authority of the Patent Co-operation Treaty has deemed the EcoGrafTM purification process as novel and inventive 8/11/2021
- the Australian Government Patent Office, through IP Australia, has confirmed acceptance of the Company’s patent application for its unique EcoGraf™ HFfree purification technology. 6/12/2021
- On 16 March 2022, the final date for public comment, IP Australia received an objection to the grant of the Australian patent from a graphite company and its process consultant. 29/04/2022 (buried in the Jan-Mar quarterly activities report)
- The Company has sought to protect its intellectual property assets through the use of patents and trademarks. During the year the International Preliminary Examining Authority of the Patent Co-operation Treaty confirmed that it has deemed all 25 of the EcoGraf HFfree™ purification process patent claims as novel and inventive. Based on this positive examination and finding, in December 2021 the Australian Government, through IP Australia, confirmed acceptance of the Company’s patent application for its unique EcoGraf HFfree™ purification technology. The purification technology was first developed by EcoGraf™ in Australia and has been refined through extensive testing and analysis conducted over the last seven years in Europe and Asia. IP Australia received objections to the grant of the Australian patent from a graphite company and its process consultant, which triggers a process of submission and hearing to enable IP Australia to determine the matter, with a decision not expected until next year. Protection of EcoGraf’s significant investment since 2015 in proprietary processing, innovation and technology is advantageous to its business and benefits Australia’s position as a major supplier of critical minerals to global battery markets. The development of new Australian technologies supported by patents strongly aligns with the core principles of the Australian Government’s Critical Minerals Strategy. 30/09/2022 via the 2022 annual report
- it has lodged with IP Australia its Evidence in Answer to oppositions raised by two parties to the Company’s Patent Application 2021261902 “Method of producing purified graphite”. 20/12/2022
- it has been made aware of an ASX announcement by RNU dated 10 August 2023 in which Renascor states “As reported in April 2022, Renascor lodged an opposition to a pending patent application relating to the purification of graphite. Renascor considers the pending patent application to be overly broad and relating to processing procedures that are not sufficiently novel or inventive to merit patent protection.” 14/08/2023
- EcoGraf is delighted that the Commonwealth Government has chosen to support its product qualification facility initiative, which is backed by the Company’s application for the Australian patent for its EcoGraf HFfree™ purification process. Protection of EcoGraf’s investment in proprietary processing, innovation and new technology provides an important competitive advantage and the development of Australian technologies supported by patents strongly aligns with the core principles of the Australian Government’s Critical Minerals Strategy (29/09/2023 via the 2023 annual report)
- An oral hearing of the opposition to the Company’s Australian Patent was held on 23 October. The decision on the Opposition has been reserved by a Delegate of the Commissioner of Patents and will likely be issued by February 2024. 30/10/2023 via Jul-Sep quarterly activities report
