    Congratulations also to the AVZ Management Team on posting the recent announcement.

    Previously AVZ advised that Jin Cheng is not entitled to have recourse to arbitration in particular because it is not a shareholder of Dathcom. It’s great to see this position has been confirmed by the ICC Tribunal. Given that Zijin is not on the Register as a shareholder in Dathcom, the purported acquisition by Zijin of its 15% shareholding from Cominière is actually ineffective. Hence AVZ’S entitlement to its pre-emptive right remains intact.


    This is the first nail in the coffin in the relationship between Zijin and Cominiere. Hence the reason why Cominiere has been scrambling to help Zijin secure the Northern section, using the original deposited funds.

    The new DRC Gov’t must be starting to see the evidence unfolding against the Chinese interests and their corrupt methods, along with the actions of Cominiere to help them acquire, at whatever cost, controlling interests in the Southern and the Northern titles.

    The corrupt dealings the Chinese have had with Gov’t appointed officials to help promote their claims against that of AVZ and its partners is now being heavily exposed by the deliberations in the International Courts and a domino effect will soon start to come through with each ruling.

    The IGF investigations and the findings presented in the September 2022 Report are undoubtedly being referenced. This report is starting to have a major influence in shaping the ICC’s decision about the agreements entered into by Jin Cheng and Cominière and the illegal processes that have followed to terminate agreements and transfer land rights.

    We now await an imminent decision from the ICSID tribunal hearing against the DRC’s failure to procure the mining permit (PE) and the subsequent penalties for the delay. We already know the ICSID has made interim orders against the DRC to ensure it takes action to reflect that AVZ (Dathcom) is the holder of PR 13359.
    Its failure to comply (based on advice, received from their Chinese Lawyers) will most likely prejudice a tough decision and fines against the DRC.

    On 25 March 2024 there is also a procedural hearing due to take place concerning Dathomir’s application in the 2019 SPA Proceedings and 2020 SPA Proceedings. We will soon learn if Dathomir follows through on claims it represented to the ICC tribunal that it will withdraw its application.


    When all of the above occurs, the heat is going to turn towards Cominiere for their role and relationship with these corrupt dealings and the actions appointed officials adopted to terminate agreements and transfer titles to other parties. Where has the money gone? Who profited from making these deals? All will soon be disclosed in the coming months and those responsible made accountable.

    These imminent decisions and rulings must bring about a willingness by the DRC to negotiate a way forward, as soon as possible. Even a T/O would help to end this saga with positive outcomes, if the DRC considered it does not want AVZ.

    In doing so the DRC needs to respect the ICC and ICSID decisions. This will show compliance with the International legal process and paying the fines even more so. I along with many shareholders look forward to watching these events unveil in the coming weeks as I do to the Fat Tail group withdrawing its legal action against the company and paying our costs.

    For Fat Tail to imply you are representing the interests of All AVZ Shareholders rather than a minority group is an embarrassment. Take action now to withdraw and avoid being reminded by the Court that you failed dismally to gain the support of shareholders at the last election and that the presiding judge decides to stand with the majority in dismissing your futile allegations.
