In fairness they havent dismissed the contempt of court action as a whole. They dismissed all of Axioms applications for information to be provided. Axiom sought court orders for substantial information and details from Google, Solomon Telekom and Sumitomo itself. They made these applications initially in 2016 and Google and Telekom provided it to the court. Sumitomo did'nt provide any information and counterclaimed to not have the google and telekom details released.
This has been the argument going on since then.
The court dismissed all the applications and ordered the material to be returned to google and telekom and awarded full costs to SMM for the whole process since 2016.
Reading the ruling it is obvious that Axioms whole case relied on having access to that information to prove a nexus between the SMM employee and SMM management. Without it the case would be weak to non existent IMO.
The contempt action is still alive with the ruling also setting down a number of dates for Axiom to file any further evidence and dates for SMM to respond. The contempt matter is listed for mention again on 31st Jan 2019.
