But did you read the bit above that that said the costs will exceed the company's present estimates which will impact on their cash outflows.

Pointedly they omitted to say by how much.

The only music to my ears would be that they were working towards a settlement but I guess there's not much that they can do if SMM wants to fight it out to the bitter end
