Awoonnga, Firstly, this case has already been to the court of appeal, at that time the appeal judges sent the whole matter to be resolved in the High Courts. This trial is for 8 weeks so that all matters are dealt with. As such there will be a clear and definitive ruling. IF there are grounds for an appeal it MAY possibly go to an appeal on those particular matters alone. But this will not stop Axiom getting on with the job if the injuction is lifted as an appeal will run parallel. But CLEARLY the court of appeal judges have already ruled as to the principles of Axioms 50 year lease - its most valuable asset.
