maybe so but IMO Eli would have deeper pockets than ACR and not sure who else they would sue. And I don't think that management would want to incur the substantial legal costs that may result as that would:

1) reduce the cash on hand for the pipeline commercialisation - and they really can't afford to delay that any longer than necessary under the circumstances;

2) reduce the cash for payment of admin/bonuses etc;

3) reduce cash to be used for R&D;

4) reduce cash that may be needed for PR.

regarding other markets for Axiron - surely these "other" markets would have been available previously but look at the infiltration that has occurred into them. Not much IMO so maybe these other markets being spoken about by other posters above are not amicable to this type of product??.

as for identifying other distributors - well theres another up in the air scenario - lets face it - FROM my understanding it wasn't any of those currently on board that had negotiated the Eli contract in the first place (but am happy to be corrected) so as for their negotiation powers - well can't comment on them but would surprise if a similar deal can be/will be made in future (that was a beauty for ACR).

anyhow nough said - over to management!!!
