At present there is only an intention to TO. As soon as this moves to an actual TO, LPD will apply and have the TO set aside until after the court case. Funding of the CC is not an issue until after the CC. LIT is playing a risky game here. In war, the footsoldiers are expendable. LIT has put their mum and dad SHs in the firing line. The question is why the TO now? Where is LIT response? Will LIT win? Where are the latest results on SL? Is SL stacking up commercially. How can LIT go forward with the commercialization of SL without a clear decision?
And the point here is why does LIT want L-Max when they have SL? One of 2 answers, (1) SL is not stacking up or inferior to L-Max or (2) Legal advice has LIT losing the CC. This combined company being better for all is baloney. LIT SHs need to be asking their fearless leader these questions now.
