Going unconditional before achieving control is a common occurrence. In this case they 'had to free the offer of this condition before Friday' or else they risked opening up the ability for people to withdraw, see Section 13.5 (2)

Yes, technically perhaps, BUT, they relied on VERY LOUD statements of if we don't get 50.1% we might withdraw.
