Yes, if BHD is wound up then BHD can't litigate against him. BHD has a rock solid case for litigation and (to borrow a term I hear used by blood sucking vampires - sorry, I meant to say lawyers - all the time) he currently has "the deepest pockets".
Dawney & Co clearly saw this coming and are selling down their holding as is evident by their most recent substantial holder notice. I think the question everyone needs to ask themselves right now is "What price is Captain Carpark willing to pay to ensure that BHD is wound up?"
