I think you'll find an EIS can't be submitted straight to the IPC. An IPC hearing is only required after 50 objections to an EIS are submitted.
The new EIS will have to incorporate all associated infrastructure and the 5 years of new data in relation to biodiversity, air and water quality, community consultation, social impacts..... A proponent wishing to submit a development application must apply to Planning for SEARS and then submit its EIS for assessment. It will be put on public exhibition so stakeholders can respond. Then there will need to be a response to any submissions. Planning will assess these and then make a recommendation. If that is Approval and there have been 50 or more objections to the new EIS only then will it go to the IPC for a public hearing. The IPC will assess the evidence and then make a determination.
The decision under the EPBC Act is only required if the IPC approves the new proposal. It will be made on the new EIS.
