She described the agreement posted to the NYCLU's website along with its report as having been "proposed" but never finalized and therefore not in effect.

"The software license agreement posted by NYCLU was proposed to the district prior to the district obtaining Smart School Bond Act approval to implement the Aegis facial recognition software as part of the district’s SSBA project," she said. "However, the agreement was never approved by the board of education, and was never executed by the parties, since the district ultimately decided to focus of utilizing SSBA monies to implement the Aegis system."
