Looking at the Dampier Port Authority annual reports they talk about the Cape Preston East development. Not sure why the DPA would actually waste time talking about something it doesnt have an interest in.

Also the DPA is now merged into a new Pilbara Ports Authority from 1 July 2014. Their website says:

"Pilbara Ports Authority was formed on 1 July 2014 as a result of the merger of the Port Hedland and Dampier Port Authorities. Stretching from the Port of Ashburton near Onslow in the south to Port Hedland in the north, Pilbara Ports Authority will include the proposed Ports of Anketell and the Cape Preston East."

In the IOH announcement Vorster said the WA Government including the DPA has supported the Port development with all necessary approvals. Im not sure how you read into that that the DPA is providing leases over crown land it doesnt administer!

Lets just agree to disagree. Im confident the DPA have the legal power to grant a lease to IOH over the Port lands. As I said, if im the lawyer on the IOH teasm drafting a lease agreement the first clause would be to the lessor warranting it has the power to actually grant a lease.
