Yes, depends on where your IP Doppelganger is at and how much research one is prepared to put into their efforts.

There's much effort in an application. Not for the light-hearted if one wants to be professional about it all. Patent attorneys laugh all the way to the bank for this stuff.
But of course, there could be 2 people across the globe at the same time are trying to apply for the same 'name' and whichever one presses 'confirm' first, first in. Could be based on timing with the epoch timestamp, I don't know how they work that out.
So, yes there could potentially be loss even after all your hard research, but after all your research, one would know whether to register or not as they have sufficient info from all the agencies. Then it's just luck that your IP Doppelganger is slow and you get in first.
