If declined most likely goes to federal court.
As taken over 1 year, I don't think the justices would be to impressed.
Depending on reason if declined, plaintiff causation and defence reply.
A court if finds in favour of advent could award punitive damages. They can be quiet high if the process was in disrepute.
I think the gov will be mindful of what may occur if declined here.
