this is going to be interesting. both parties have entrenched themselves in their positions. you would think that it would be a case of applying facts to the agreement so it should be fairy dry. wonder what Sm1 would argue to defend the exclusive rights. maybe they will try to blame A2M for forecasting but that would be a weak argument unless forecasting is linked to sm1s obligation to supply
