Well it does say that the bids will be placed on market for the ELDPA - so I don't think anybody could think there is any implied guarantee that everybody would choose to sell them. So for that reason my unqualified opinion is that it is not misleading at all.
From the pres - two bullet points:
Cash offer available to all Hybrid holders immediately
Simple structure –sell on market and receive proceeds in 2 business days
