I'm on the sidelines now after trading ELD Friday - but if I was an ELDPA holder, I would like to see some very specifically worded confirmation that if an ELDPA holders sells on market, that they are getting the exact same deal as the "big 4" players mentioned. The placement amount is just a bit too close to the value of the hybrid acceptances mentioned to not ask that question. You wouldn't want to find out that the placement recipients were the big four, and that holders who sell on market do not get discounted shares.
Unfortunately the markets are a bit of a snake-pit. I'm no lawyer - maybe they have to disclose that, but the selling has been outsourced, so I suspect there is room for plausible deniability.
