Indeed that's usually the case for private investors, however given that these shares appear to be part of the M&A - to an entity now controlled by XTE - and AFAIK to a controlling interest that still works under the XTE umbrella - it's hard to argue that XTE weren't aware that the 2nd biggest holder sold 15% off the registry and were powerless to enforce continuous disclosure....
