FND exports a 'refined/processed product' which is a massive hurdle. So that rule doesn't apply. The divestment laws state all foreign companies have to "relinquish their majority stake in the Indonesian mines they own by the end of the tenth year of production". This is possibly an issue for FND but not a major one IMO. They already have a JV partner and currently their mine life ends before the 10 year time limit. Lets hope (and assume) they extend their mine life beyond 10 years. Then its a matter of divesting. Divesting was an issue for Grasberg due to the enormous size/value of the project. Essentially no-one wanted to cough up a fair valuation because that was simply too much money. With our project I think a fair valuation and price could be agreed on readily enough.
