I've gone back on my last post already but Hiddenvalue's question "Can the bidder acquire shares before the shareholders vote and a court order is granted on a scheme? " Made me look that up and found a few other things as a result, it appears that it is legally possible but many bidders avoid doing so before the court action to avoid regulatory risk.
But in researching this I found another gem which I'll post separately and is the best way forward for retail shareholders. I urge to read when I collect my information.
