What comes out of MLX contesting the counter offer will be very interesting. MLX obviously treating it very seriously, suggest worst outcome will be compensation, best outcome HOA honoured. What will be interesting is that TAM BOD will be pushing hard to get this resolved asap, their personal exposure could be put at risk, if MLX unwilling to negotiate and push contract t and c. If MLX happens to get up, there needs there is likely to be a fall guy. You can always argue that TOM, "acting in best interests where was NST during the JV tender process??????
Waiting for a deal and HOA to be finalised, terms released to mkt in order that their counter offer can made knowing what the terms are?
Suggest that aint good management from both TAM and NST. Will be very interesting if MLX takes further. Risk of major reputational damage is massive.
