I may reconsider after having a look at the initial releases by each Co.
MLX only stated subject to 3rd party consent
whereas
TAM states subject to shareholder approval but it is the directors who sign a heads of agreement not shareholders
while both said 'binding'
If MLX were not aware of any subject to in regard to shareholder approval then there could be an issue..
As you say Peter Cook knows his legalities but it will be difficult and drawn out to prove that the heads of agreement is enforceable
