It takes time to collect the evidence necessary for a successful prosecution. I'm sure people remember the bollockings ASIC has received in the past for unsuccessful prosecutions of corporate failures.

I'd suggest management wouldn't be apologising as it could be used against them in a later prosecution (and would probably be getting advice from lawyers and director insurance policy staff to keep their mouths shut). One could cynically view Aboud's decision to put his house on the market as one step towards protecting his financial interests in any potential prosecution.
