Let’s face it, chances of successful legal action by foreigners in the PRC is low to very low.
Since XPD is HK registered, it’s under the jurisdiction of the HK regulators. These are proper non-corrupt regulators, and used to dealing with dodgy PRC executives. IMO the Mejority guys should focus here rather than the PRC, even if any cash in the HK accounts has already been moved. The HK SFC can make life difficult even for PRC nationals, if they are directors of HK companies. This may be a better pressure point than legal action in the PRC, although can do both of course ..
