They can use nominees, they can loan their rights to others that do nefarious stuff too. However, they are bigger than most ASX listings at $3.5B so won't want to bring themselves under the ire of ASIC with predatory acts. They did stop short with at a working margin of TO threshold, which in the absence of anything other than conjecture is appropriate. They also signals to others that it would be difficult to undertake appropriation of FBR - (but I'd welcome greater Euro interest all the same).
