The answer the original question can probably addressed by the fact that CSS have had no problem paying their own costs to bring the legal action & haven't been material to the results of the company.
Paying the costs of the defendants on losing would most likely be of a very similar level all be it being paid in one lump sum & as such would not be of an order that would threaten the viability of the company. Also worth noting that the company would not have started legal action or been allowed to do so if there was a perception that they couldn't pay defendants costs on losing.
Plus the auditors would have to have put a note in the accounts regarding not being a going concern if they lost the case, clearly this is not the case.
I personally am not banking on them winning the case & it was never part of my investment decision. I still believe the sp will be around double the current level in approx. 2 years time even if they don't win.
