    Unfortunately that is correct, they somehow avoided the 3% creep rule on a timing technicality

    That being said, there is a T/O provision in the announcement where they acquired the 10M, for up to 6 months

    IMO, they could still have a T/O in mind, but have used this to news to ice the recent rally
