again, not sure of the disclosure rules but I am sure you could complain to ASIC or ASX if you think they have been breeched. If you give it some thought, taking up his full entitlement when the full rights were not taken up would have increased his percentage. Given we were something like $2M short then I would expect he would easily have gone over 20%.
Yes, he could have drip fed some of the shortfall but how many and when? His notice after all the shortfall shares they think are going to be taken up makes sense.
The issue is are we now still about 7M shares in shortfall ~ circa $700k ? Are those shortfall shares still able to be taken up? Are they likely to be or is the rights issue now closed?
I have asked some questions of Havilah regarding the 2 major shareholders indicated in the rights booklet and will update this if I get a response.
