    Yes, but that is now irrelevant. See clause 4.1:

    • The Buyer [Nordgold] grants the Seller [GoldFields] an option (Call Option) to purchase the Call Option Shares in accordance with this agreement

    GoldFields can if they wish exercise the option following certain events, but that option is now over 0 shares (Nord own nothing and obviously have no intention of acquiring more stock), so in effect it can not be exercised.
