Yes looks like the case. Australian Super say they don’t lend stocks for shorting but they have custodians (banks / brokers) who they don’t control and hence their shares can be ultimately used for shorting. Not sure if ADR holders can instruct not to lend their shares? I imagine the agreement would state their shares could be used that way?
