You obviously have not read the takeover documents closely. Or maybe you have and are hoping to mislead the large number of minority shareholders who have not accepted the Goldway offer.
ASIC imposed a requirement that Goldway (the bidder) must get acceptances from 50% of all minority shareholders for the bid to succeed. If this minimum condition is not met by Friday 5 April (2 days) then the takeover fails and all acceptances are cancelled (ie: no shares are transferred and the shareholders go back to the way they were).
In summary - they started at 64% and they need to get to 82%. They currently have 76% so they are 2/3rds of the way there with 2 days to go.
Not sure that they are going to get there.
