state street is either a custodian or an index manager .The funds they hold as index they lend and generate a fee for doing so .That is where the short seller borrow from .Or if the funds that state street hold on behalf of someone as a custodian then if the holder allows stock lending they can do so on behalf of someone other than state street .That why the whole short selling rules are a debacle as there is very little transparency as to who is doing what
