Brian owns roughly 40% of ICL and is prevented from increasing his voting power to a position below 90% under 606(1) of the corps act. He would be relying an an exception to this in s611, namely the 3% creep - i.e. he can only increase his interest by a maximum of 3% in any 6 month period.
