The announcement quoted the courts decision - it ordered that unless the defendant appeals the courts decision, the defendant is to pay the amount by 18th October. What if it doesn't pay? The company has written the amount off & has stated it has reservations about its payment. I highly doubt the company wants to, or is in any position to, pursue actions in courts. It seems to have made that clear, it's concerned about counter-claims.
The fact that it was manufacturing in breach of local environmental laws is big a worry.
The 2021 accounts was where the manufacturing constraints was first mentioned. Update in Sept 2021 said this "we have identified a payment to a local government official apparently to allow wastewater to continue to be discharged into the drainage system. Our investigations are still ongoing, but we believe that such payments may have been made with the knowledge or approval of Australian-based managers." This is the AFP bribery case.
Also their contradiction regarding RS. In a May 2022 announcement this was stated "Our intention is to imminently file a legal claim seeking damages from former director Zhigang Zhang. In addition, we have served a letter of demand on our former CEO and Managing Director Rob Schuitema".
Then in the pre-reinstatement disclosures announcement in Sept 2022 they are saying "The May Announcement stated the Company’s “intention is to imminently file a legal claim seeking damages from former director Zhigang Zhang. In addition, it stated the Company’s intention is to “serve a letter of demand on our former CEO and Managing Director Rob Schuitema". "The Company notes that in many circumstances, the initiation of a claim can accelerate or heighten the prospect of counterclaims, or of separate claims relating to similar matters."
