CHM tried the "constructive trust" to claim capital in the project and that was rejected.
The judge has said that if an account of profits was sought then the court would make an allowance of MMX's 100's of millions of dollars compared to CHM's $277,840. Even if you said MMX was only 200million, CHM's account of profits would be less than 0.14% of profits.
Read this over and over if you don't get it
Murchison's "interest in the project" was not the profit or benefit which Murchison received by reason of the breaches of fudiciary duties.
