    Indeed the CEO/MD of BRL,at the time the deal was signed, is a witness on behalf of L & M mining and supports L & M's view and understanding of the contract that the word shipping was more a generic term and no such industry pacifics were ever discussed or agreed to. This was also supported by BRL's other negotiator at the time who is still a director.

    If this is true and Hamish is a witness for L&M l’m dissapointed the company is wasting time and money litigating this matter, even if we can wriggle out on a technicality. What they will pay the lawyers will probably end up being half the payment which nobody disputes has to be paid eventually anyway. Should have just negotiated a more practical settlement.

    Pull your fingers out management. Kill off the distractions and get on with the real job!
