Yes perhaps the plaintiff is also confident of a successful BLA.
Better settle now as a approval could result in a decision by the court to award all costs to the plaintiff, that would also open the way for a lawsuit against them.
By the way, if you had bothered to look up the various court orders you would well be aware that all communication from the FDA to MSB was required to be filed to the court.
They obviously didn't find the Golden Egg.
