My personal opinion is that the previous CEO wanted to fight it tooth and nail to defend it. This new CEO has come in, seen all the evidence and believes its better settled, dealt with and move on. The new CEO would want to start the company on fresh ground where he can achieve everything he wants to, rather than keep legacy items floating around.
