it's the company that makes the primary determination if an announcement is price-sensitive.
The ASX reviews rerains the authority to query for compliance. Indeed it has happened a few times with stocks that i follow, where a "Please explain why you marked this as price sensitive" has been sent. The opposite happens too - "why did you not mark this as proce sensitive"?
