PDN have neither the time nor the money to go to court. They do have obligations to bondholders which must be addressed next month at a minimum though.
I would imagine that the CEO who's restructure plan has not worked will want to get away from PDN and on with his life as soon as possible.
This will probably mean taking the easiest and shortest route out, and blaming PDN'S demise on previous management. .
